K-POP 안무의 저작권 보호의 윤리적 정당성 연구

K-POP 안무는 단순한 신체적 움직임이 아니라 창작자의 예술적 개성과 기술적 역량이 반영된 창작물로, 대중문화 산업에서 중요한 역할을 한다. 그러나 현행 저작권법은 안무의 보호 범위를 명확히 규정하지 않아, 창작자의 권리 보호와 대중적 확산 사이의 균형을 모색하는 것이 중요한 과제로 대두되고 있다. 본 연구는 Kant의 의무론과 Mill의 공리주의를 바탕으로 K-POP 안무 저작권 보호의 윤리적 정당성을 분석하고, 창작자의 권리를 보장하면서도 산업적 확산과 창작 생태계의 조화를 고려한 보호 방안을 제안한다. Kant의 의무론은 창작자의 권리를 절대적으로 보호해야 함을 강조하며, 무단 사용이 윤리적으로 정당화될 수 없음을 시사한다. 반면, Mill의 공리주의는 안무의 자유로운 활용이 산업 성장과 창작 활성화에 기여할 수 있음을 제안하며, 보다 유연한 저작권 보호 체계를 요구한다. 본 연구는 이러한 두 가지 윤리적 관점을 바탕으로 K-POP 산업의 특성을 반영한 저작권 보호 기준을 정립하고, 창작자와 대중이 공존할 수 있는 지속 가능한 문화 생태계를 구축하기 위한 시사점을 제공하고자 한다. 이를 통해 K-POP 안무 저작권 보호 정책과 창작 환경의 균형을 모색하는 데 기여하고자 한다.

K-POP choreography is not merely a series of physical movements but a creative work that embodies the artistic individuality and technical expertise of the choreographer, playing a crucial role in the popular culture industry. However, current copyright law does not clearly define the scope of protection for choreography, making it a significant challenge to balance the protection of choreographers’ rights with the widespread dissemination of their work. This study analyzes the ethical justification for the copyright protection of K-POP choreography by applying Kant’s deontological ethics and Mill’s utilitarianism. Furthermore, it proposes a protection framework that ensures choreographers’ rights while maintaining harmony between industrial expansion and the creative ecosystem. The findings suggest that Kant’s deontological ethics emphasize the absolute protection of choreographers’ rights, arguing that unauthorized use cannot be morally justified. In contrast, Mill’s utilitarian perspective highlights the potential benefits of the free utilization of choreography in fostering industrial growth and creative engagement, advocating for a more flexible copyright protection system. By integrating these two ethical perspectives, this study aims to establish a copyright protection standard that reflects the unique characteristics of the K-POP industry and provides insights into building a sustainable cultural ecosystem where both choreographers and the public can coexist. Ultimately, it contributes to the discussion on balancing copyright protection policies with the creative environment in the K-POP industry.
